These Terms and Conditions of Sale apply to all purchases made from ELYROA (“the Seller”) by consumers (“the Customer”) through the website www.elyroa.com.
These Terms apply to sales made to consumers residing in the United Kingdom, without limiting any mandatory consumer protection rights available to them under applicable law.
They set out the conditions governing orders, prices, payments, delivery, returns, refunds and warranties.
Additional terms may be presented to the Customer before an order is placed. The version applicable to an order is the version available on the Website when that order is submitted.
ELYROA sells convertible corduroy sofa beds through the Website.
The main characteristics of each Product, including its dimensions, materials, colour, intended use and other relevant specifications, are displayed on the corresponding product page. The Customer must review this information before placing an order.
Product photographs are intended to represent the Products as accurately as possible. Minor variations in colour may result from screen settings, lighting conditions or the natural appearance of the upholstery. Such minor variations do not affect the essential characteristics of the Product.
The Customer is responsible for checking the Product’s dimensions and ensuring that the package and Product can pass through the doors, corridors, stairways and lifts leading to the intended room.
The contractual information intended for Customers in the United Kingdom is provided in English.
Products are offered subject to availability.
If a Product becomes unavailable after an order has been placed, ELYROA will inform the Customer as soon as reasonably possible. The Customer may then choose an available alternative, where appropriate, or receive a refund for the unavailable Product.

The Customer selects the Products they wish to purchase and adds them to their basket. Before submitting the order, the Customer can review the selected Products, quantities, delivery information and total price, and correct any errors.
By submitting the order and completing the payment process, the Customer confirms that they have reviewed and accepted these Terms and Conditions of Sale and that the order carries an obligation to pay.
After the order has been submitted, ELYROA sends an acknowledgement or confirmation email to the address provided by the Customer. The sales contract is formed when ELYROA confirms acceptance of the order.
ELYROA may refuse or cancel an order for a legitimate reason, including:
If ELYROA cancels an order after payment has been collected, the relevant amount will be refunded using the original payment method.
Requests to amend an order must be sent as soon as possible to contact@elyroa.com.
ELYROA cannot guarantee that an order can be amended once it has been prepared, processed or dispatched.
The Customer may request cancellation through their account at https://account.elyroa.com or by emailing contact@elyroa.com.
If the order has already been dispatched, the Customer may exercise their statutory right to cancel in accordance with Article 10.
Product prices are displayed in pounds sterling (GBP). The price applicable to an order is the price displayed when the Customer submits that order.
Any discount or promotion is applied according to the conditions displayed on the Website. Price changes do not affect orders that have already been confirmed.
Standard delivery is free unless a different charge is clearly displayed before the order is submitted.
Before completing the purchase, the Customer is shown the total amount payable to ELYROA.
Payment is due when the order is placed and is processed through the secure payment methods available at checkout.
Available payment methods may include Visa, Mastercard, American Express, Apple Pay, PayPal and Klarna. The options actually available may vary according to the Customer’s location, device, order value and the eligibility requirements of the payment provider.
Klarna payment options are subject to Klarna’s eligibility checks and terms. ELYROA does not decide whether an application for Klarna financing is accepted or refused.
If a payment is refused, cancelled or not authorised, the order cannot be confirmed.
In the event of suspected fraudulent use of a payment method, the Customer should contact their payment provider and ELYROA without delay.
ELYROA currently delivers exclusively to addresses in the United Kingdom, subject to carrier coverage and accessibility.
Orders are generally prepared and dispatched within 1 to 2 working days. Delivery after dispatch generally takes 2 to 4 working days.
The total estimated delivery time is therefore 3 to 6 working days from order confirmation and successful payment validation.
These times are estimates and may occasionally be affected by periods of high demand, transport disruption, adverse weather, remote delivery locations or circumstances outside ELYROA’s reasonable control.
Delivery is made to the address provided by the Customer when placing the order. The Customer must ensure that this address is complete, accurate and accessible.
The risk of loss or damage remains with ELYROA until the Customer, or a person nominated by the Customer other than the carrier, takes physical possession of the Product.
If delivery does not take place within the agreed period, the Customer may ask ELYROA to complete delivery within an additional reasonable period. If delivery is still not completed within that period, or where delivery by the original date was essential, the Customer may cancel the order in accordance with their statutory rights.
Any refund resulting from a valid cancellation due to non-delivery will be issued without undue delay and no later than fourteen (14) calendar days after the cancellation is confirmed.

Ownership of the Products transfers to the Customer once full payment has been received.
Regardless of when ownership transfers, the risk of loss or damage transfers only when the Customer, or a person nominated by the Customer other than the carrier, takes physical possession of the Product.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer may cancel an online order within fourteen (14) calendar days of receiving the Product, without providing a reason.
ELYROA also provides an extended commercial returns period allowing the Customer to request a return within thirty (30) calendar days of receiving the Product, subject to the conditions set out below.
Where several Products from the same order are delivered separately, the cancellation period begins when the final Product is received.
To request a cancellation or return, the Customer must contact ELYROA within the applicable period:
After exercising the statutory right to cancel, the Customer must return the Product without undue delay and no later than fourteen (14) calendar days after notifying ELYROA.
The Product must be returned complete and accompanied by all accessories and instructions supplied with it. Where reasonably possible, it should also be returned in its original packaging.
The Customer may handle the Product only to the extent reasonably necessary to establish its nature, characteristics and operation. ELYROA may make an appropriate deduction from the refund where the Product has lost value as a result of excessive handling.
For returns requested between the fifteenth (15th) and thirtieth (30th) day following delivery, the Product must be complete, undamaged and in a condition suitable for resale.
Return costs are the Customer’s responsibility when the return results from a change of mind. As an unpacked sofa bed may require a large-item carrier, the Customer must contact ELYROA before arranging the return.
ELYROA will cover reasonable return costs where the Product is confirmed as faulty, damaged, incorrect or not as described.
Before sending a Product back, the Customer must contact ELYROA to receive the applicable instructions and return address. A Product must not be returned to ELYROA’s administrative address unless ELYROA expressly confirms that address for the return.
When the statutory right to cancel is validly exercised, ELYROA will refund the amount paid for the Product and any standard delivery charge paid by the Customer. Any additional amount paid for a more expensive delivery method is not refundable.
The refund will be issued without undue delay and no later than fourteen (14) calendar days after ELYROA is informed of the cancellation. ELYROA may withhold the refund until the Product has been received or the Customer provides evidence that it has been returned, whichever occurs first.
Returns made under ELYROA’s extended commercial returns policy will be refunded after the Product has been received and inspected.
The refund will be issued using the original payment method unless the Customer expressly agrees to another method that does not result in additional charges.
The right to cancel does not apply to Products made to the Customer’s specifications or clearly personalised, except where the Product is faulty, damaged or not as described.
Products sold through www.elyroa.com are intended for domestic use. They must match their description, be of satisfactory quality and be fit for their usual intended purpose.
Under the mandatory rights applicable to consumers in the United Kingdom, a Customer may be entitled to a repair, replacement, price reduction or refund where a Product is faulty, damaged, incorrect or not as described.
In addition to these statutory rights, ELYROA provides a free two-year commercial warranty beginning on the delivery date. This warranty covers manufacturing, material and structural defects arising during normal domestic use.
The commercial warranty does not cover normal wear and tear, misuse, insufficient maintenance, accidents, unauthorised modifications or damage caused after delivery by inappropriate handling. These exclusions do not limit the Customer’s statutory rights.
To submit a claim, the Customer must contact contact@elyroa.com, providing the order number and a description of the problem. Photographs or videos may be requested where reasonably necessary to assess the issue.
If a return is required, ELYROA will provide the relevant instructions and will cover the reasonable return costs of a Product confirmed as faulty or not as described.
ELYROA’s two-year commercial warranty is additional to the Customer’s statutory rights and does not replace or restrict them.
ELYROA processes personal data where necessary to manage orders, payments, deliveries, returns, customer accounts and customer service requests.
Personal data may be shared with service providers involved in fulfilling the order, including hosting, payment, logistics, communication and technical service providers.

The Website and its content, including text, photographs, graphics, logos, videos and visual elements, are owned by or licensed to ELYROA and are protected by applicable intellectual property laws.
No part of the Website may be reproduced, modified, published, distributed or commercially exploited without ELYROA’s prior written permission, except where permitted by law.
ELYROA will not be responsible for a failure or delay caused by circumstances outside its reasonable control. Nothing in this Article limits any mandatory consumer rights or any responsibility that cannot lawfully be excluded.
Neither party will be liable for a failure or delay in performing an obligation where that failure or delay results from an event beyond its reasonable control, including major transport disruption, natural disaster, fire, flood, industrial action, government action or failure of telecommunications networks.
This provision does not affect the Customer’s statutory rights, including any right to cancel and obtain a refund where applicable.
These Terms and Conditions of Sale are governed by French law. However, this choice of law does not deprive a consumer residing in the United Kingdom of any mandatory protection available under the law applicable in their country of residence.
The English version of these Terms is the contractual version provided to Customers placing orders through the United Kingdom storefront.

ELYROA and the Customer will attempt to resolve the dispute amicably.
The Customer may also seek assistance from the UK International Consumer Centre or use any alternative dispute resolution procedure available under applicable law.
If an amicable resolution cannot be reached, the dispute may be brought before the courts having jurisdiction under the applicable legal rules.
Before placing an order, the Customer is given access to the essential Product characteristics, total price, payment methods, delivery arrangements, cancellation rights, returns conditions and these Terms and Conditions of Sale.
By submitting an order carrying an obligation to pay, the Customer confirms that they have reviewed and accepted this information and these Terms.
Products supplied to consumers in the United Kingdom must be as described, of satisfactory quality and fit for their usual intended purpose.
Where a Product does not meet these requirements, the Customer may have the right to reject it, request a repair or replacement, obtain a price reduction or receive a refund, depending on the circumstances and the time at which the problem is reported.
These rights exist independently of ELYROA’s two-year commercial warranty. Nothing in these Terms excludes or restricts any statutory right that cannot lawfully be excluded or restricted.
